Military Diversion and Veterans Treatment Court: A Path to Recovery and Dismissal

Latest Articles

California offers unique legal programs for military members and veterans charged with crimes, such as Military Diversion (Penal Code Section 1001.80) and Veterans Treatment Court. These programs provide eligible participants with tailored treatment plans, community support, and a path to dismiss criminal charges without a conviction.

Military Diversion is a pre-plea program for misdemeanor offenses that allows veterans to avoid a criminal record by completing treatment. Veterans Treatment Court, available for more serious cases, focuses on rehabilitation through comprehensive resources while offering reduced penalties and opportunities for expungement.

Both programs emphasize addressing service-related conditions such as PTSD, substance abuse, and mental health issues. Participants benefit from mentorship, connection with fellow veterans, and access to VA resources, including housing, employment, and counseling services.

These programs help veterans reclaim their lives, protect their careers, and avoid the stigma of a criminal conviction. They also foster a collaborative environment where all parties—judges, attorneys, and mentors—work toward the participant’s success.

Starting January 2025, expanded laws will extend Military Diversion to certain felony cases, broadening access to life-changing support for veterans in need.
