Venturing into the Online World
Tread carefully, as simple chats can lead to serious legal troubles. Today, we highlight the dangers of interacting with minors and the complexities of online consent. Learn to navigate these digital pitfalls to safeguard your virtual interactions.
The Importance of Verifying Age and Consent
The goal is to keep you out of trouble. To do that, you must ensure you’re talking to an adult, especially when fantasies involve juveniles or discussions related to them.
Topic 1: Internet Crimes
The age of the internet has brought unique challenges and problems that our clients face on a daily basis. One of the biggest problem areas we see in dispute on a daily basis involves cases with issues of either age or consent.
“I agree with that, Roland. When discussing legal issues related to the age of the person our clients interact with online, people need to use extreme caution. You don’t know who’s behind the screen; it could be anyone.”
The Risks of Online Interactions
In one instance, a client conversed with a girl online who claimed to be 18 but turned out to be 13. She sent nude photos and messages to multiple men, unaware that they were committing a crime by receiving those images.
“Our client met with this person in person, thinking she was 18, but found out later she was underage. This poses a significant problem, especially in California, where there’s strict liability for individuals who engage in sexual activities with someone under 14, regardless of their knowledge or intent.”
Fantasy Situations and Online Interactions
Another area where age can be a problem is in fantasy situations online. For example, some adults engage in role-playing fantasies involving younger individuals. “If you’re an adult having conversations that revolve around fantasies involving younger people or pretending to be younger, you need to establish clear boundaries between fantasy and reality. You don’t want to end up in a situation where you’re sending explicit messages or photos to someone you think is an adult but turns out to be a minor.”
Law Enforcement and Online Stings
Law enforcement often engages in online sting operations, where officers pose as minors to catch potential offenders.
Maintaining Records of Consent
Always maintain records of your communications and consent. This is crucial in case of accusations. Deleting evidence of consensual activities can be dangerous, as it may be perceived as non-consensual.
Interacting with Human Beings Online
When interacting with people online, remember that you’re dealing with human beings who have emotions, feelings, and needs. Don’t cheapen interpersonal relationships by reducing them to transactions.
The Transactional Nature of Online Interactions
When engaging in transactional interactions, have a clear understanding of what the transaction entails. Consider having a contract or agreement, just like in business.
The Role of Consent Forms
Some colleges are teaching students to sign consent forms before engaging in sexual activities. While this may seem ridiculous, it can help prevent misconceptions and accusations.
Being a Decent Human Being
Ultimately, being a decent person and treating others with respect and sensitivity can go a long way in preventing false allegations and hard feelings.
Protecting Yourself
In transactional online interactions, protect yourself by being clear about your intentions and boundaries. Consider drafting a contract or agreement to safeguard against potential allegations.
